The thesis of 3D/4D equivalence states that every three-dimensional description of the world is translatable without remainder into a four-dimensional description, and vice versa. In representing an object in 3D or in 4D terms we are giving alternative descriptions of one and the same thing, and debates over whether the ontology of the physical world is "really" 3D or 4D are pointless. The twins paradox is shown to rest, in relativistic 4D geometry, on a reversed law of triangle inequality. But (...) considering the twins as 3D beings who age through time, the paradox implies that time passes at different rates in different reference frames, and therefore that the concept of a single global or Absolute time is unsustainable. This article surveys arguments for the claim that employees have a right to strong forms of decision-making participation. Itconsiders objections to employee participation based on shareholders' property rights and it claims that those objections are flawed. In particular, it argues the employee participation rights are grounded on the same values as are property rights. The articlesuggests that the conflict between these two competing rights claims is best resolved by limiting the scope of corporate property rightsand by recognizing a strong employee (...) right to co-determine corporate decisions. This paper examines the ethics of using assistive technology such as video surveillance in the homes of people living with dementia. Ideation and concept elaboration around the introduction of a camera-based surveillance service in the homes of people with dementia, typically living alone, is explored. The paper reviews relevant literature on surveillance of people living with dementia, and summarises the findings from ideation and concept elaboration workshops, designed to capture the views of those involved in the care of people living (...) with dementia at home. The research question relates to the ethical considerations of using assistive technologies that include video surveillance in the homes of people living with dementia, and the implications for a person living with dementia whenever video surveillance is used in their home and access to the camera is given to the person’s family. The review of related work indicated that such video surveillance may result in loss of autonomy or freedom for the person with dementia. The workshops reflected the findings from the related work, and revealed useful information to inform the service design, in particular in fine-tuning the service to find the best relationship between privacy and usefulness. Those who took part in the workshops supported the concept of the use of camera in the homes of people living with dementia, with some significant caveats around privacy. The research carried out in this work is small in scale but points towards an acceptance by many caregivers of people living with dementia of surveillance technologies. This paper indicates that those who care for people living with dementia at home are willing to make use of camera technology and therefore the value of this work is to help shed light on the direction for future research. The aim of the paper is to prove the consistency of libertarianism. We examine the example of Jane, who deliberates at length over whether to vacation in Colorado (C) or Hawaii (H), weighing the costs and benefits, consulting travel brochures, etc. Underlying phenomenological deliberation is an indeterministic neural process in which nonactual motor neural states n(C) and n(H) corresponding to alternatives C and H remain physically possible up until the moment of decision. The neurophysiological probabilities pr(n(C)) and pr(n(H)) evolve continuously (...) according to the different weights Jane's judgement attaches to C and H at different times during the deliberation. The overall process is indeterministic, since Jane's exact judgemental weighting would vary slightly were the process to be repeated from the same initial conditions. The weighting is however rational, and entirely under Jane's control. This controlled, rational, indeterministic process shows that libertarianism is a consistent philosophical thesis. (shrink)

The United States is distinctive among advanced economies in that its employment laws and practices are governed byEmployment at Will (EAW). Most other nations have variations on Just Cause dismissal rules. I argue that the U.S. preference for EAW is unsupported by concerns about net social or economic consequences. More centrally, I argue that the basic moral commitments that underlie the U.S. system of private property and freedom of contract are commitments that lend support to Just Cause over EAW.

We all make decisions, sometimes dozens in the course of a day. This paper is about what is involved in this activity. It's my contention that the ability to deliberate, to weigh different courses of action, and then to decide on one of them, is a distinctively human activity, or at least an activity which sets man and the higher animals apart from other creatures. It is as much decisio as ratio that constitutes the distinguishing mark of human beings. Homo (...) may not always be rationalis, but he is always decidens.The paper is about practical decision, although there is also another important kind of decision that I won't discuss, namely cognitive decision. The difference is roughly that which distinguishes the function of a jury from that of a judge, at least in jury trials. The jury's job is to arrive at an answer to the question: guilty or not guilty? This is a cognitive decision, a decision that, on the basis of the evidence, such-and-such is the case. The judge, apprized of the jury's cognitive decision, makes the practical decision to sentence the guilty party to 20 years. On some other occasion, I hope to be able to say something about cognitive decision, as well as about a third kind of decision named value decision. (shrink)

In this chapter, I propose to use the layered structure of a Russian Doll Model initially used by Frans de Waal and some of the most recent and influential empirical studies to interpret ceyin zhi xin. At the core of ceyin zhi xin, I argue, lies the Perceptive-Affective-Motive Triplet that includes perceptive, affective and motivational aspects. The Russian Doll Model helps to illustrate the structure of ceyin zhi xin as containing both the multifaceted triplet as its inner layer and higher (...) cognitive activities—such as long-term memory, taking perspectives other than one’s own, semantic processing and imagination—as its outer layers. These outer layer faculties make the normative and cultural development of ceyin zhi xin possible. The higher cognitive capacities are in close contact and constantly interacting with the triplet. I argue that this model is the best interpretative model for ceyin zhi xin because of its rich support from empirical studies, its emphasis on the interactions of the different aspects of ceyin zhi xin, as well as how it explains the normative and cultural potential of ceyin zhi xin. This essay reconsiders Foucault’s writings on the Iranian Revolution in the context of his thought during 1977-1979. The essay defends three related claims: (1) Foucault does not turn away from power toward ethics as many scholars have claimed, (2) Careful interpretation of the texts on the Iranian Revolution will help us to better understand Foucault’s essays and lecture courses from this period (in particular, the relationship between political spirituality and counter-conduct), and (3) During this period Foucault is working on conceptualizing (...) modernity as a multivalent set of practices—some that reinforce power relations and some that resist them. The basis of a rigorous formal axiomatization of quantum mechanics is constructed, built upon Dirac's bra-ket notation. The system is three-sorted, with separate variables for scalars, vectors and operators. First-order quantification over all three types of variable is permitted. Economy in the axioms is effected by, e.g., assigning a single logical function * to transform (i) a scalar into its complex conjugate, (ii) a ket vector into a bra and a bra into a ket, (iii) an operator into its adjoint. There can be no disputing the proposition that doctors and nurses should be held accountable for their professional activities. In most circumstances this accountability should be achieved through appropriate and effective complaints and disciplinary procedures, but there will be cases where the criminal law should become involved. The criminal law, however, is a serious weapon, and should only be used to punish those whose conduct is truly criminal; it should not be used against those who have merely made a human (...) error. The task of the law should therefore be to identify those situations where a doctor or nurse has behaved in a way which demonstrates a criminally culpable state of mind. In this respect, NZ has been out of step with other comparable jurisdictions and has demonstrably failed to distinguish between cases where death is caused accidentally (through the making of an ordinary human error) and cases where it is caused criminally (through recklessness or culpable negligence). A stranger runs out of a bank while I am sitting at the wheel of my car waiting for the lights to change; he jumps in beside me, points a gun at me, and says, “Drive me to St. Bruno.” This is Andre Gombay's example, from his excellent paper on duress. The question that interests Gombay and me is: Could I refrain from doing what the gunman asks?

Over the last 25 years, experimental findings published by Benjamin Libet have indicated that conscious acts of will are preceded by a characteristic kind of brain event of which the agent is not conscious. It, Libet says, rather than the will, is what causes actions. His discoveries, if correct, would seem to imply that the notion of a free, conscious will is an illusion, and that actions are initiated by neural processes not under conscious control. In what follows it is (...) argued that Libet’s conclusion is incorrect, and that other evidence points to the essential causal role of consciousness in voluntary action. (shrink)

Commentators often construe Foucault as an anti-Enlightenment thinker; much of this criticism assumes that Foucault inherits early German Romanticism in some sense. This essay examines these claims by assessing the role the German Romantics play in Foucault’s work, both early and late. After a brief consideration of the meaning of the term “Romanticism,” the essay examines the role that language and literature plays in Foucault early texts before examining the place of self-formation or Bildung in his later work. I conclude (...) that examining the relationship between Foucault and the German Romantics can help us better understand Foucault’s texts and thereby avoid what Foucault terms the “blackmail of the Enlightenment,” the idea that one must be either for or against Enlightenment ideals rather than critically interrogating them.
